PlantAI – Terms of Service

1. Introduction
These Terms of Service ("Terms") apply to the use of the PlantAI mobile application ("App") and the associated website plantai.app (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and all applicable laws and regulations.
Please read these Terms carefully. They form a binding legal agreement between you and [PlantAI Inc.] ("we", "our", "PlantAI").
Our Privacy Policy explains how we collect and use your information, including personal data under GDPR and other data laws. You must agree to both these Terms and the Privacy Policy to use our Services.
We may update these Terms periodically. The latest version will always be available on our website or in the App. Continued use of our Services after changes are made constitutes your acceptance of the updated Terms.
2. Eligibility
You must be at least 13 years old and legally able to enter into contracts to use PlantAI. If you are under 18, you must have parental consent to use the Services.
You are responsible for ensuring the device on which you install the App is owned by you or used with permission. You also accept full responsibility for the usage of the App on that device.
3. Use of Our Services
3.1 Plant Identification
PlantAI uses AI technology to identify plants from photos. While we strive for accuracy, identifications are not 100% guaranteed and should not be solely relied upon for critical decisions (e.g., determining if a plant is safe to consume).
3.2 Disease Diagnosis
Our disease identification feature provides suggestions based on visual analysis. These are not professional diagnoses and should not replace expert botanical or agricultural advice when needed.
3.3 Location Services
We use location data to provide weather information and location-specific plant care advice. You may manage this via your device settings.
3.4 AI Botanist
The AI Botanist feature powered by ChatGPT provides general plant care advice. This is not a substitute for professional horticultural consultation for valuable or rare plants.
4. Account and Usage
You may need to create an account to access premium features. You are responsible for maintaining the confidentiality of your account credentials.
Free users receive:
- 2 plant identifications
- 2 disease identifications
- Unlimited water calculator usage
- Basic AI botanist queries
5. Fees and Payments
Premium subscriptions unlock unlimited identifications, mushroom identifier, and advanced features. Payment is processed via app stores.
Subscriptions automatically renew unless cancelled before the renewal date. You can manage subscriptions via your app store account.
6. User Content
By uploading plant photos, you grant us a license to use them for improving our AI models and services. We do not share your photos publicly without permission.
You retain ownership of your content but grant us necessary rights to provide the Services.
7. Intellectual Property
All content in the App—including logos, design, code, and plant database—is owned by PlantAI or its licensors and protected by intellectual property laws.
We grant you a limited license to use the App for personal, non-commercial purposes.
8. Acceptable Use
You agree not to:
Use the Services for any illegal purposes
Attempt to reverse engineer our AI models
Harvest data from our plant database
Share your account with others
Misuse the identification features for harmful purposes
9. Disclaimers
Plant identifications and care advice are provided "as is" without warranties. We are not responsible for:
Misidentification of plants or mushrooms
Plant health issues despite following our advice
Allergic reactions or poisoning from plants
Loss of valuable plants
10. Limitation of Liability
To the extent permitted by law, PlantAI's total liability is limited to the amount you paid for premium subscription in the past 12 months.
We are not liable for indirect, consequential, or incidental damages.
11. Privacy and Data
Your use of PlantAI is subject to our Privacy Policy. We collect and process data as described there, including plant photos and identification history.
12. Termination
We may suspend or terminate accounts that violate these Terms. You may delete your account at any time via the App settings.
13. Changes to Terms
We may update these Terms with notice via the App or email. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of [United States], without regard to conflict of law principles.
